Welcome to Guide Intelligence Limited (referred to as the "we", "us", or "our”). These Terms of Use ("Agreement") are a legally binding agreement between you ("you" or "user") and Guide Intelligence Limited regarding your access to and use of the App.

By accessing or using the App, you confirm that you have read, understood, and agree to be bound by this Agreement. If you do not agree with any part of these terms, you must not use the App.

1. License

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App solely for your personal, non-commercial use in accordance with this Agreement.

You agree not to:

• Decompile, reverse engineer, or otherwise attempt to discover the source code;
• Modify, adapt, translate, or create derivative works;
• Sell, sublicense, distribute, or exploit the App in any unauthorized manner.

2. Subscriptions and Payments

• Subscription Plans: Subscription pricing and details are displayed within the App. Prices may vary by region and are subject to change with prior notice.
• Free Trial: If a free trial is offered, it will automatically convert to a paid subscription unless canceled at least 24 hours before the end of the trial period.
• Auto-Renewal: All subscriptions are automatically renewed unless auto-renew is turned off at least 24 hours before the end of the current billing period.
• Managing Subscriptions: You can manage and cancel your subscriptions by going to your Apple ID settings. Deleting the App does not cancel an active subscription.
• Billing: Payments are processed through Apple and subject to Apple's own terms and policies.

3. Refund Policy (App Store)

All purchases made through the App are processed by Apple Inc. via the Apple App Store and are subject to Apple's refund policies.

• Refund Requests: If you wish to request a refund for a subscription or in-app purchase, you must submit your request directly to Apple through the App Store. We do not have access to or control over Apple's payment processing system.
• Refund Eligibility: Apple determines refund eligibility on a case-by-case basis according to their own policies. We recommend reviewing Apple's terms of sale at Apple's Terms of Sale.
• No Guarantee: Refunds are granted at Apple's sole discretion. We cannot guarantee that a refund will be approved.
• Service Access: If Apple approves your refund, your access to premium features or subscription services will be terminated immediately or at the end of the current billing period, depending on Apple's policy.
• Contact Us: While we cannot process refunds directly, if you experience technical issues or have questions about subscription features, please contact us at support@guideyy.com and we will assist you.

4. User Conduct

You agree not to use the App to:

• Violate any applicable laws or regulations;
• Infringe on the rights of others;
• Upload harmful or malicious content;
• Interfere with or disrupt the integrity or performance of the App.

5. Intellectual Property

All content, design, trademarks, graphics, and source code in the App are owned by us or our licensors and are protected under intellectual property laws.

You may not copy, reproduce, modify, or distribute any part of the App without our prior written consent.

6. Privacy

Your use of the App is also governed by our Privacy Policy which explains how we collect, use, and protect your personal information in compliance with applicable laws, including GDPR if you are located in the European Economic Area (EEA).

7. AI-Powered Features

The App incorporates artificial intelligence ("AI") technology to provide certain features, including but not limited to personalized fasting insights, meal analysis, food recognition, and health-related suggestions. By using the App, you acknowledge and agree to the following:

• AI Technology Providers: Our AI features are powered by third-party AI models, including OpenAI GPT-4.1-nano and Google Gemini 3 Pro, accessed through the Replicate platform. These models process your inputs to generate responses and recommendations within the App.
• Not Medical Advice: All AI-generated content, including fasting plans, meal suggestions, nutritional analysis, and health tips, is for informational and general wellness purposes only. It does not constitute medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before making any health-related decisions.
• Accuracy Limitations: AI-generated content may not always be accurate, complete, or up-to-date. We do not guarantee the reliability, accuracy, or suitability of any AI-generated output. You should independently verify any information before relying on it.
• No Guarantee of Availability: AI features depend on third-party services and may be temporarily unavailable, degraded, or discontinued at any time without prior notice.
• Data Processing: When you use AI-powered features, certain data you provide (such as text inputs, food images, or health preferences) may be sent to third-party AI service providers for processing. This data is handled in accordance with our Privacy Policy and the respective privacy policies of our AI providers. We do not sell your personal data to AI providers.
• User Responsibility: You are solely responsible for how you use and act upon AI-generated content. We are not liable for any actions taken based on AI outputs.
• Content Generation: AI outputs are generated algorithmically and may occasionally produce unexpected, inaccurate, or inappropriate results. We continuously work to improve the quality and safety of AI outputs but cannot guarantee perfection.
• Age Restriction: AI-powered features are intended for users aged 18 and above, or the age of majority in your jurisdiction. Minors should use AI features only under parental or guardian supervision.

8. Third-Party Services

The App may contain links or integrations with third-party services, including but not limited to AI service providers (Replicate, OpenAI, Google). We are not responsible for the content, policies, or practices of any third-party websites or services. Your use of third-party services is subject to their respective terms and privacy policies.

9. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding the operation or availability of the App, or that it will be error-free.

10. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to damages arising from reliance on AI-generated content.

11. Termination

We reserve the right to suspend or terminate your access to the App at any time if you violate this Agreement or misuse the service.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes become effective constitutes your acceptance of the revised Terms.

13. Governing Law

This Agreement is governed by and construed in accordance with the laws of the jurisdiction of incorporation, without regard to conflict of law principles.
